Neigbourhood disputes

Luxembourg adopted the European Mediation Convention in 2012 (EU Directive 2008/52/EC of EU Parliament & Council of 21 May 2008) to be in line with European mediation policy. As part of this adaptation, the social and regional mediation service is proposed, a voluntary process to resolve neighbourhood conflicts within municipalities in the country.

The importance of offering the neighbourhood mediation service within a municipality.

  • Mediation is a voluntary and open process of outcome in which the mediator helps the mediators, under their own responsibility, to find a solution in a confidential setting.
  • Mediation is above all a chance for both sides to reach an agreement. It can lead to a peaceful resolution of a dispute
  • Participation in mediation is voluntary. Either party may freely terminate the mediation.
  • Being able to use a neutral third party trained in mediation can help people in conflict to re- establish or strengthen dialogue. This allows the mediated to be listened to in their emotions and needs.
  • Mediation sometimes makes it possible to envisage the maintenance of the social relationship or bond with a restored or strengthened trust.
  • The process is in the hands of the parties, so that strict procedural rules do not have to follow strict rules of procedure. The course of the mediation can thus be adapted to the needs of the media.
  • This is a simple and relatively quick way to resolve a dispute.
